same behaviour on 3
i'll not fix this on 3 cause of mssql and i don't have a mssql environment to test

Not sure if that's the same bug or should we create new one?
Joomla is no longer crushing, but tree created (all unpublished) looks like a bug. It looks like it creates category for every article in the category.
