With the configuration of the reference issue it does not give the contacts of the nested category. This with and without patch applied

I have tested this item? unsuccessfully on 52802e8
While this change does resolve the issue I raised it also introduces a new one.
Now when you just select a category in the searchtools it will only show the contacts of that category and not also include the contacts in the subcategories.
If you look at the equivalent queries in the content model they are very different
