The static function menuitems is only used for the batch process. There is no need to exclude the URL type because this type can also have children in the menu. With the exclusion the batch process usage for this constellation is impossible.

How to reproduce the problem and/or test the patch::
Create a menu structure with the top level an external URL, sub-menu items can be anything. Have at least two child levels: - External URL Top Level -- 1st Child Level Article -- 1st Child Level Article --- 2nd Child Level Article --- 2nd Child Level Article Select the two '2nd Child Level Articles' and use the 'batch' feature to move them to be a child of the top level item. The top level item is not available to be selected in the menu dropdown. Set the top-level item to be a text separator (for example) and it is possible to select it using the method above.
