we can just change the notice message as the request is created even if mail not working ?

Just checked and we do need it. The request might be stored in the database but the user is not able to confirm their request as we don't send out the email for them to verify the request.
So I would say that the fix for this is to not save the request if the email can not be sent, not to change the text
i'm afraid we are going to deal with the "Chicken or the egg" paradox
if we 1st send the email but for some reason(issue) then we can't store the data on the privacy_request table

The bug is that you do not have mail enabled or configured correctly. Just because the email did not get sent is no reason to block the submission
